LEGAL AND LICENSING

This is the privacy statement of Heretic Design, located at 3985 SX, Werkhoven (hereinafter Heretic Design), www.hereticdesign.nl. 

 

Applicability 

This privacy statement applies to all privacy sensitive information or personal data you provide to us, for example through a registration form, contact form or orders you place. We attach great importance to the privacy of our customers and therefore take the greatest possible care in handling and protecting personal data. We process data in accordance with the conditions imposed on it in the General Data Protection Regulation (AVG). Heretic Design is the controller within the meaning of the AVG with respect to the processing of your personal data. This means that only we determine which personal data are processed, for what purpose and in what way. We are responsible for ensuring that your personal data is processed in a proper and careful manner in accordance with the AVG. In this privacy statement, we explain which data we process and for what purposes they are used. 

  

Overview personal data 

Below is an overview of the personal data we process: 
 

  • First and last name 

  • Gender 

  • Date of birth 

  • Place of birth 

  • Address data 

  • Phone number 

  • E-mail address 

  • IP address of a website visitor 

  • Bank account number  

  

Purpose and bases of processing personal data 
If you have not given us explicit consent to process your personal data or if you have withdrawn such consent, the processing of your personal data may be subject to the bases of Articles 6(1)(b), (c) and/or (f) of the AVG. Processing of your personal data may in that case take place without your consent, provided that this is necessary for the performance of an agreement to which you are or become a party, or necessary for the representation of the legitimate interests of Heretic Design. In addition, we may be under a legal obligation to process your personal data. 

 

  • We process your personal data for the following purposes: 

  • Handling your payment 

  • Sending our newsletter and/or advertising folder 

  • Calling or e-mailing you if this is necessary to carry out our services 

  • To inform you about changes to our services and products 

  • To deliver goods and services to you 

 

We will not retain your personal data longer than is strictly necessary to fulfill the purposes for which your data is collected. 

  

Provision to third parties 


We may share your personal data with third parties if this is compatible with the purposes stated above. Provision to third parties may be necessary for the performance of the agreement we enter into with you, necessary to pursue a legitimate interest of ours, or necessary to comply with any legal obligation incumbent upon us. With companies that process your data on our behalf, we conclude a processing agreement to ensure the same level of security and confidentiality of your data. We remain responsible for these processing operations. Other than the foregoing situations, we only provide your personal data to other third parties with your express consent. 

   

Commercial purposes 

We may use your personal data for commercial purposes, for example to inform you further about our services or relevant products or services of carefully selected organizations. You will in that case only be informed at the e-mail address you have registered. If you do not wish to receive information about relevant products or services, you can easily indicate this by clicking on "unsubscribe" in the received email. 

 

Your personal data will also be used by us for market research and the optimization of our services. In this context, your personal data will be anonymized and can therefore no longer be traced back to you.

View, correct or delete 

You have the right to inspect, correct or delete your personal data. You also have the right to withdraw your possible consent to data processing or object to the processing of your personal data. You have the right to data portability ("data portability") if we have digital personal data that we either process with your consent or process to carry out an agreement we have with you. 

  

This means that you can submit a request to us to send the digital personal data that we hold about you in a readable computer file to you or another organization named by you. 

 

You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your consent or objection to the processing of your personal data to info@hereticdesign.nl. 

 

To make sure that the request for inspection is made by you, we ask you to send a copy of your proof of identity with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks. 


We would also like to remind you that you have the possibility to file a complaint with the national regulator, the Personal Data Authority.
